Prosecutors Using New Law On Distracted Drivers

ABATE of Minnesota helped lead the charge to get a new law passed during the 2015 Minnesota legislative session that will hold distracted road users accountable for causing crashes that result in great bodily harm or death.  This new law gives prosecutors a gross misdemeanor option for prosecuting these cases.

Sadly this new law has come into play. A new Prague man lost his life when he was hit by a distracted driver that was texting at the time of the crash. That driver has been charged with Gross Misdemeanor Reckless Driving and Misdemeanor Misuse of a Wireless Communication Device. The driver could face up to one year in prison and a $3,000 fine for the reckless driving charge.

This is one small step in our fight against distracted driving. We all need to be vigilant, we need to put pressure on prosecutors to use this new law when appropriate and we also need to spread the word to let all road users know that there are consequences for distracted driving.
